Overview

Under the supervision of the General Counsel, provide high-quality and cost-effective legal services to the School Board of Orange County, Florida, and OCPS District staff relating to planning, land use, construction, and real estate matters.

Responsibilities and Qualifications

QUALIFICATIONS:



  1. Juris Doctorate from an accredited law school.

  2. Member in good standing of The Florida Bar.

  3. Five (5) years of experience as a practicing attorney required; ten 10 years preferred.

  4. Board Certification in Construction Law, City, County or Local Government, or Real Estate, preferred.



KNOWLEDGE, SKILLS AND ABILITIES:
Knowledge of real estate, zoning, land use, construction, and eminent domain laws. Experience drafting and negotiating transactional documents for real estate acquisitions, sales, leasing, easements, and licenses. Experience with eminent domain matters. Experience reviewing survey and title matters. Experience obtaining entitlement process with planners and design professionals and negotiating and drafting development and proportionate share agreements. Experience working with construction matters in the pre-litigation stage. Must have knowledge or ability to research applicable laws, legal codes, court procedures, precedents, government regulations, agency rules, and executive orders. Able and willing to handle real estate and other litigation matters from inception to conclusion. Ability to manage multiple tasks and projects and meet deadlines. Strong attention to detail. Ability to act with integrity, professionalism, and confidentiality. Knowledge of Florida laws including Government in the Sunshine laws, administrative laws, and public records. Knowledge of laws pertaining to public education highly desirable. Ability to independently perform legal research and analysis via conventional and computer-based methods. Ability to work and communicate effectively with people to focus resources (both human and financial) toward the achievement of district goals. Ability to facilitate group processes in consensus building, conflict resolution, planning, and decision making.

PHYSICAL REQUIREMENTS:
Describes the physical conditions of this position.

Light Work: Exerting up to twenty (20) pounds of force occasionally and/or up to ten (10) pounds of force frequently. If the use of arm and/or leg controls requires exertion of forces greater than that for sedentary work and the worker sits most of the time, the job is rated as Light Work.

WORKING CONDITIONS:
Conditions the worker will be subject to in this position:

Indoors and outdoors: The worker is subject to both environmental conditions. Activities occur inside and outside.

PERFORMANCE RESPONSIBILITIES:
∗ Manifests a professional code of ethics and values.

* Understand the district’s needs and requirements related to real estate matters and advise accordingly.
∗ Draft and review real estate contracts.
∗ Conduct title searches and examine property titles.
* Advise district staff on legal issues related to site acquisitions and disposition of real estate.
∗ Advise district staff on site selection, title, and survey examinations addressing zoning and land use issues.
∗ Negotiate terms and conditions and draft routine sale or lease agreements and amendments.
∗ Ensure compliance with local, state, and federal real estate laws.
∗ Draft and file necessary legal documents regarding property transactions.
∗ Manage closing and ensure that appropriate approvals are in place before all transactional legal documents are executed.
∗ Facilitate the resolution of disputes between the district and other parties involved in real estate transactions.
∗ Provide legal counsel during property development and construction projects.
∗ Assess environmental impact and regulatory compliance issues.
∗ Assist with pre-litigation construction issues and management of claims and disputes.
∗ Represent the School Board in coordination with the General Counsel in disputes concerning real estate and construction matters before
courts and administrative agencies.
∗ Monitor legal risk in real estate transactions and documentation.
∗ Assist in drafting and/or reviewing contracts and documents.
∗ Assist in drafting and/or reviewing board policies.
∗ Assist and provide legal guidance on issues related to public records requests.
∗ Assist the General Counsel in the development and preparation of legal opinions on more complex matters.
∗ Under the direction of the General Counsel, perform a wide variety of duties including the provision of legal services for all departments, divisions, and offices of the school district.
∗ Conduct legal research and analyze contracts, statutes, recorded judicial decisions, legal articles, and other codes and regulations to prepare legal documents and provide sound legal advice.
∗ Follow federal and state laws, as well as school board policies.
∗ Keep the General Counsel informed of all critical issues and incidents.
∗ Provide annual and period reports and feedback regarding services performed in the area of responsibility.
∗ Follow the district’s policies and procedures as related to all HRMD guidelines, executive limitations, the district’s instructional initiatives.
∗ Follow the district’s policies and procedures as related to fixed assets.
∗ Develop leadership in subordinates.
∗ Responsible for keeping up to date with current technology being used by OCPS. With the support of the district, attends training to ensure skill level in various technologies is at the level required to perform in current position.
∗ Responsible for maintaining timely and accurate information and accountable for the quality of information maintained by those they supervise.
∗ Accountable for self-development and keeping informed about current research, trends, and best practices relevant to the area of responsibility.

∗ Perform other duties and responsibilities as assigned by the supervisor.

TERMS OF EMPLOYMENT:
Non-bargaining unit compensation plan, twelve months, 8.0 hours per day.

EVALUATION:
The performance of this job will be evaluated in accordance with the provisions of the Board's policy on the evaluation of personnel.
